A trademark is an industrial property right which entitles its proprietor to use that mark exclusively in the course of trade for the goods or services for which it is registered. The function of a trade mark is to distinguish the goods and services of its proprietor from those of a competitor and to indicate the origin of the goods. The trade mark must be distinctive, that is to say, it must not describe the goods or services for which it is sought.

Today, a trademark is one of the most important IP rights for many companies. European Union trademark is a cost efficient way to get your brand protected in 27 Member States simultaneously. The application process takes around 4-5 months from filing to registration if everything goes smoothly, and depending on whether you use the Fast Track or not. The registration is valid for 10 years and can be renewed as many times as wanted.

We can also assist in filing applications in almost any country in the world or with international trademarks. International registrations of trademarks are registrations conducted under an agreement called the Madrid Protocol. It’s a system for obtaining trade mark protection for a number of countries and/or regions using a single application. You need a basic registration/basic application in a Member Country to file the international application.The international registration is effective in the designated countries where there are no obstacles to the registration under their laws. You can request a territorial extension of protection after the registration. An international registration is valid for ten years and it can be renewed for further periods of ten years.

TRADEMARK CLASSIFICATION

In addition to the exact same mark, the scope of protection applies to a similar mark registered for the same or similar products or services. For well-known brands, the scope covers all products and services under certain conditions. Trademarks are divided into 45 categories for different products and services that limit the scope of trademark protection. In addition, a delimitation must be made within the trademark categories by means of a list of goods or services. We assist to the desired extent in the classification of goods / services and in the determination of the best field of protection.
